India and the United States are edging closer towards signing the End User Verification Agreement (EUVA) which will apply to all deals related to military procurement.
Senior delegates from the Indian Defence Ministry as well as top U.S delegates including the National Security Advisor have been negotiating to formalize the final draft of the EUVA agreement. The visit by the U.S Secretary of State Hillary Clinton in July to India is expected to coincide with the finalization of the agreement.
India has been wary of the clause in the EUVA which relates to “on-site verification”. While the U.S is bound by State laws to apply these rules related to sensitive technology, India has been citing reservations against any agreements that cannot be amended in the future. Besides that, giving access to foreign inspectors to defence bases is also a crucial issue.
Other contentious issues include a standardised text of the EUVA. It was indicated that the text should be frozen and not subjected to changes citing amendments to the existing or enactment of fresh U.S.laws. In addition, the changes in the standardised text would be applicable only if both sides agreed to it. This standardised text would do away with the need to negotiate a stand-alone agreement whenever defence procurement was made from the U.S.
